By registering and using ClearShip, you accept these Terms of Service. If you do not agree with these terms, you may not use the platform.

ClearShip is a web-based platform for managing boat maintenance tasks. The service includes:

• Management of boats and maintenance tasks
• Interactive boat schematics with task markers
• Photo galleries and file attachments
• Notes and comment features
• Collaborative features for working with crew and service providers

Registration is required to use ClearShip. You agree to:

• Provide truthful and complete information during registration
• Keep your login credentials confidential and not share them with third parties
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

Upon registration, you receive a non-exclusive, non-transferable right to use ClearShip in accordance with these terms. It is prohibited to:

• Use the platform for unlawful purposes
• Upload or distribute malicious software
• Circumvent or manipulate the platform's security mechanisms
• Upload content of third parties without their consent
• Use the platform in a way that impairs its operation

Your Content: You retain all rights to the content you upload to ClearShip (images, documents, descriptions). You grant us a limited license to store, process, and display this content for the purpose of providing the service.

Our Content: The ClearShip platform, including its design, code, logos, and text, is protected by copyright. Reproduction or distribution without our consent is prohibited.

ClearShip offers various subscription tiers. When subscribing to a paid plan, the following applies:

• Billing occurs in advance for the chosen billing period
• Subscriptions renew automatically unless cancelled before the end of the current period
• Price changes will be communicated at least 30 days in advance
• Refunds are handled in accordance with applicable law

Payment processing is handled by Stripe. Stripe's terms of service apply additionally.

We strive to provide ClearShip with high availability. However, we cannot guarantee uninterrupted availability. In particular, we are not liable for:

• Scheduled maintenance
• Disruptions due to force majeure
• Outages of third-party providers (hosting, payment processors)

The service is provided "as-is" without express or implied warranties regarding fitness for a particular purpose.

To the extent permitted by law, we are only liable for damages caused by intent or gross negligence. Our liability is in any case limited to the subscription fees paid by you in the last 12 months.

We are specifically not liable for:

• Data loss, unless caused by our gross negligence
• Indirect damages or consequential damages
• Lost profits

By You: You may terminate your account at any time. Paid subscriptions can be cancelled at the end of the current billing period.

By Us: We reserve the right to suspend or delete accounts that violate these Terms of Service. In cases of serious violations, this may occur without prior notice.

After termination, your data will be handled in accordance with our Privacy Policy.

The protection of your personal data is important to us. Details on the collection, processing, and use of your data can be found in our Privacy Policy.

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to you at least 30 days before taking effect via email. Continued use of the platform after the changes take effect constitutes acceptance of the modified terms.

These Terms of Service are governed by Swiss law. The place of jurisdiction is Frauenfeld, Switzerland, to the extent permitted by law.

For consumers within the EU, the mandatory provisions of consumer protection law of their country of residence additionally apply.
