By registering and using ClearShip, you accept these Terms of Service. If you do not agree with these terms, you may not use the platform.

Upon registration, you receive a non-exclusive, non-transferable right to use ClearShip in accordance with these terms. It is prohibited to:
Your Content: You retain all rights to the content you upload to ClearShip (images, documents, descriptions). You grant us a limited license to store, process, and display this content for the purpose of providing the service.
Not Designed for ID Copies and Highly Sensitive Content: ClearShip is boat management software. Information customary for operating a boat – such as crew lists containing name, date of birth, nationality, and ID document number – is part of the intended use; you remain responsible for this data (see "Third-Party Personal Data"). ClearShip is, however, not designed to store copies or scans of passports, identity cards, or other official identity documents, nor special categories of personal data such as health or biometric data. We expressly recommend that you refrain from uploading such content. If you nevertheless do so, this is at your own risk and your sole responsibility; the indemnity under "Third-Party Personal Data" also applies to such content. We reserve the right to remove such content and to inform you accordingly.
Third-Party Personal Data: If you upload content containing personal data of third parties – such as purchase or service contracts, invoices, or crew details – you are the controller for that processing. You warrant that you have a valid legal basis and have informed the data subjects to the extent required by law. You indemnify us against claims by third parties and against fines arising from a breach of this warranty.
Visibility of Your Content: Content you assign to a boat is visible to everyone you have invited to that boat, including crew members and external service providers such as shipyards. Before uploading, please check whether this group of people may see the content in question.
Our Content: The ClearShip platform, including its design, code, logos, and text, is protected by copyright. Reproduction or distribution without our consent is prohibited.
ClearShip offers various subscription tiers. When subscribing to a paid plan, the following applies:

We strive to provide ClearShip with high availability. However, we cannot guarantee uninterrupted availability. In particular, we are not liable for:
The service is provided "as-is" without express or implied warranties regarding fitness for a particular purpose.
To the extent permitted by law, we are only liable for damages caused by intent or gross negligence. Our liability is in any case limited to the subscription fees paid by you in the last 12 months.

By You: You may terminate your account at any time. Paid subscriptions can be cancelled at the end of the current billing period.
By Us: We reserve the right to suspend or delete accounts that violate these Terms of Service. In cases of serious violations, this may occur without prior notice.
Deletion of Your Data: You can delete your account yourself at any time (Profile → "Delete account"). If we terminate an account due to a violation, we will – except in cases of serious violations – give you 30 days to export your data before deletion. Which data is removed upon account deletion and which data we must retain under statutory retention obligations is described in our Privacy Policy.
The protection of your personal data is important to us. Details on the collection, processing, and use of your data can be found in our Privacy Policy.
Data Processing Agreement: Insofar as you process personal data of third parties through ClearShip (e.g. crew members or service providers), you are the controller and we act as processor, solely to provide the service and in accordance with your instructions. If you are legally required to conclude a data processing agreement – in particular under Art. 28 GDPR or Art. 9 FADP – we will conclude one with you upon request. Please contact [email protected].
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to you at least 30 days before taking effect via email. Continued use of the platform after the changes take effect constitutes acceptance of the modified terms.
These Terms of Service are governed by Swiss law. The place of jurisdiction is Frauenfeld, Switzerland, to the extent permitted by law.
For consumers within the EU, the mandatory provisions of consumer protection law of their country of residence additionally apply.
